This is an appeal from a judgment of the circuit court which affirmed the order of the Industrial Commission awarding compensation to Eva June Wise because of the injuries and death of her husband, Winslow Wise. The deceased lived in Hayward, Wisconsin, and was employed by the plaintiff James Buick Garage as a car salesman on a salary basis. He drove a car furnished by the employer and usually worked Washburn, Sawyer and Bayfield counties although he and the other salesman had no definite territory. They were expected to go out and drum up business on their own. Wise had formerly been a high school teacher in Bayfield, Wisconsin, and had frequently gone there to sell cars. In selling, Wise would drive whatever car he was trying to sell at the time. He was under no special assignment, was not required to file reports or to inform his employer in advance of his proposed itinerary. On Saturdays it was customary for one of the salesmen to work at the garage in the morning and the other in the afternoon. The one working in the afternoon would be off work on Sunday. Early on Saturday, September 12, 1959, Winslow Wise, who was expected to work at the garage in the afternoon, left Hayward, traveled north to Washburn some 62 miles, then continued on 12 miles to Bayfield. At Bayfield he contacted a retired newspaper publisher Frank Dexter to whom he had been attempting to sell a car. Dexter was interested in buying a car and was negotiating with another garage. Wise made a tentative appointment with Dexter to come back to see him before 2 o'clock that afternoon and if he was not back then he would see Dexter the next morning.
